These Terms and Conditions ("Terms") govern the contractual relationship between:

By making a booking or purchasing a product, you agree to be bound by these Terms.
2. Scope of Services
We provide the following services:
2.1 Photography Services
- Photo Walks: Guided photography sessions in various locations
- Portrait & Photoshoots: Individual or group photography sessions
- Real Estate Photography: Professional property photography
2.2 Digital Products
- E-books: Photography guides, tutorials, and educational materials in digital format
- Presets: Photo editing presets and tools
3. Prices and Payment
3.1 Pricing
All prices are displayed in EUR or CZK (as indicated on our website) and include VAT where applicable.
3.2 Payment Methods
We accept the following payment methods:
- Credit/Debit Card via Stripe
- Bank Transfer (details provided upon booking confirmation)
3.3 Payment Terms
- Photography Services: Payment is due at the time of booking or as specified in the booking confirmation.
- Digital Products: Full payment is required before download access is granted.
3.4 Invoices
An invoice will be issued for each purchase and sent to your email address.
4. Booking Services (Photography)
4.1 Booking Process
- Select your desired service and available time slot
- Provide your contact information (email, phone, or Instagram handle)
- Confirm your booking and complete payment
- Receive booking confirmation via email
4.2 Booking Confirmation
A booking is confirmed once:
- You receive a confirmation email from us, AND
- Payment has been received (or payment details confirmed for bank transfer)
4.3 Cancellation and Rescheduling
By Client:
- Free cancellation: You may cancel or reschedule your booking free of charge up to 48 hours before the scheduled session
- Late cancellation: Cancellations made less than 48 hours before the session will result in forfeiture of 50% of the booking fee
- No-show: Failure to appear for a scheduled session without prior notice will result in forfeiture of the full booking fee
By Service Provider:
- We reserve the right to cancel or reschedule bookings due to:
- Severe weather conditions
- Illness or unavailability of the photographer
- Force majeure events
- In such cases, you will receive a full refund or be offered alternative dates at no extra charge
4.4 Changes to Bookings
Changes to booking details (date, time, service type) must be requested at least 48 hours in advance and are subject to availability.
4.5 Client Responsibilities
- Arrive on time for your scheduled session
- Provide accurate contact information
- Notify us immediately of any changes or cancellations
- Follow safety instructions during outdoor sessions
5. Digital Products (E-books & Presets)
5.1 Purchase and Delivery
- Upon successful payment, you will receive an email with download links
- Download links are valid for 365 days and allow 5 downloads
- It is your responsibility to download the files within the validity period
5.2 No Refund Policy
Digital products are non-refundable. Due to the nature of digital goods:
- Once you have received access to download the product, no refunds will be issued
- This policy applies even if you have not downloaded the files
- Please review product descriptions carefully before purchase
Exception: Refunds may be granted at our sole discretion if:
- The product is substantially different from its description
- Technical issues prevent you from accessing the download
- Payment was processed in error
5.3 License and Usage Rights
By purchasing our digital products:
- You receive a personal, non-exclusive, non-transferable license to use the product
- You may use the product for personal or commercial projects (unless otherwise specified)
- You may not:
- Resell, redistribute, or share the product with others
- Claim the product as your own work
- Use the product in a way that violates applicable laws
5.4 Technical Requirements
It is your responsibility to ensure your device meets the technical requirements for using our digital products. We do not guarantee compatibility with all devices or software.
6. Intellectual Property Rights
6.1 Photography Services
- All photographs taken during our sessions are protected by copyright and remain our property
- You will receive usage rights as specified in your service agreement
- You may not use the photographs for purposes beyond the agreed scope without written permission
6.2 Digital Products
- All e-books, presets, and content are protected by copyright
- Usage is governed by the license terms in Section 5.3
6.3 Website Content
All content on our website (text, images, graphics, logos) is protected by intellectual property rights and may not be reproduced without permission.
7. Liability
7.1 Service Quality
We strive to provide services of the highest quality. However:
- Photography is influenced by factors beyond our control (weather, lighting, client cooperation)
- We do not guarantee specific results or outcomes
- We are not liable for subjective dissatisfaction with creative work
7.2 Limitation of Liability
To the extent permitted by law:
- Our liability is limited to the amount paid for the service or product
- We are not liable for indirect, consequential, or special damages
- We are not liable for damages resulting from force majeure events
7.3 Photography Sessions
- Outdoor sessions carry inherent risks (uneven terrain, weather)
- You participate at your own risk and are responsible for your own safety
- We are not liable for injuries or damages except in cases of gross negligence or willful misconduct
7.4 Digital Products
- We are not liable for technical issues with your devices
- We are not liable for how you choose to use the products
- We do not guarantee that our products will meet your specific requirements
8. Data Protection and Privacy
We process your personal data in accordance with:
- General Data Protection Regulation (GDPR)
- Our Privacy Policy (available on our website)
8.1 Data We Collect
When you book services or purchase products, we collect:
- Contact information (name, email, phone, Instagram handle)
- Payment information (processed securely through Stripe)
- Booking details and preferences

- Technical failures of third-party services
In such cases, we will make reasonable efforts to notify you and offer alternatives.
10. Dispute Resolution

These Terms are governed by the laws of the Czech Republic.
10.2 Jurisdiction
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.
10.3 Consumer Rights
If you are a consumer, you retain all mandatory rights granted by consumer protection laws, including:
- Right to a 14-day cooling-off period (except for digital products where download access has been provided)
- Right to file a complaint with consumer protection authorities

10.4 Amicable Resolution
We encourage you to contact us first to resolve any issues. We are committed to finding fair solutions.
11. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be effective:
- Immediately upon posting on our website for new bookings/purchases
- For existing bookings/purchases, the Terms in effect at the time of booking apply
We will notify you of material changes via email or website notice.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
